截停及查問. 根據《 警隊條例 》（ 第232章 ） 第54 (1)條 ，警務人員有權截停任何形跡可疑的人，亦可以要求對方出示身分證明文件（香港身分證或護照），並當場把該人扣留一段合理時間，以查問他有否涉嫌在任何時間干犯任何罪行。 至於怎樣才是「形跡可疑」，則純粹按照警務人員之主觀判斷而定。 話雖如此，警務人員必須有真實懷疑，才會採取行動。 《 公安條例 》（ 第245章 ） 第49條 容許警務人員以防止、偵察或調查任何罪行之目的，要求任何人出示身分證明文件作查閱。 在此情況下，任何人如未能出示身分證明文件，即屬違法。 根據《 入境條例 》（ 第115章 ） 第17C (2)條 ，警察及入境事務主任亦有權向任何15歲或以上之香港居民查閱身分證明文件。
