以職責來說，持牌保險經紀是代表投保人，他會在不同保險公司所提供的產品中，選擇一個較為符合投保人需要的產品。而持牌保險代理則代表保險公司，向投保人士推銷保險產品。根據法例，任何公司或從業員，均不可同時具有持牌保險經紀及持牌保險代理人的身份。
按《保險業條例》(第 41 章) 有關持牌保險中介人「適當人選」 的準則指引，保監局會根據保險中介人的學歷及專業資格*、工作經驗、信譽、 品格、可靠程度及財政狀況等，決定是否向其發出或更新牌照。詳情可按此了解更多。
成為中介人前，他們必須要閱讀申請保險中介人牌照須知，由所屬的保險公司或持牌保險經紀公司協助提交成為保險中介的申請。若要成為個人持牌保險中介人，就必須「透過電子服務站保險中介一站通向保監局遞交網上申請，或透過書面形式遞交保險中介人牌照申請表格。
